Town of Smithers files injunction on Sedaz Lingerie; offers solution

The Town of Smithers has applied for an injunction in BC Supreme Court, trying to get a local business to remove its legal signage.

The application seeks a “permanent injunction requiring (Sedaz) to remove the Sedaz Signs from the Property within 7 days and to thereafter cease from erecting the Sedaz Signs on the Property.” Should Sedaz not take them down within 7 days, there will be “an order authorizing the Petitioner (Town) to remove the Sedaz Signs from the Property.” The injunction was filed on March 1st.

Two of Sedaz Lingeries signs violate height and width sign bylaws. One of which projects out into Main Street 22 inches. The signs only have a vertical clearance from the ground of 076 metres. The signs also interfere with the Town’s use of a snowplow to clear snow off of sidewalks.

Owner Amy Brandstetter says she’s sought legal advice.

“My lawyer had sent them a letter asking them if they would be willing to work with me and it would be better to communicate and deal with the situation and their response is just to take me to court.

In a statement on Facebook, Mayor Taylor Bachrach says he’s willing to buy Sedaz a new sign – with his own money – to “save both Amy and the Town the cost of lawyers.”

In total, the town approached two businesses with non-compliant signs. The other business removed their signs.
